CabinCalm Terms of Use

These Terms of Use (“Terms”) govern your use of the CabinCalm mobile application and related forecast service (“CabinCalm”), provided by João Reis (“we”, “us” or “our”). By using CabinCalm, you agree to these Terms. If you do not agree, do not use the service.
1. What CabinCalm provides
CabinCalm provides weather-based estimates of how smooth or bumpy an airport-to-airport journey may feel. Forecasts may include an overall comfort score, route segments, confidence information and explanatory weather factors.
CabinCalm uses a representative route between the selected airports. It does not identify or track a particular aircraft, and the actual flight path, timing, aircraft and conditions may differ.
2. Important safety limitation
CabinCalm is a passenger-comfort information service only. It is not an aviation safety, dispatch, navigation, operational, medical or emergency service. Do not use CabinCalm to make flight-planning, routing, go/no-go or safety decisions. Always follow instructions from the airline, crew, airport and relevant authorities.
Forecasts are estimates, not guarantees. Weather, routing and flight operations can change quickly, and data may be delayed, incomplete or unavailable.
3. Eligibility and acceptable use
You may use CabinCalm only in compliance with applicable law and these Terms. You must not misuse the service, interfere with its operation or security, attempt to bypass access limits, scrape the service at scale, or use forecasts for operational aviation purposes. Restrictions on copying, reverse engineering and redistribution are also governed by Apple’s Standard Licensed Application End User License Agreement, except where applicable law does not allow such restrictions.
4. Free access and CabinCalm Pro
CabinCalm may provide limited free access and offer CabinCalm Pro through Apple’s In-App Purchase system. The subscription title, duration and current price are shown before purchase. Available plans may include monthly and annual auto-renewable subscriptions.
Payment is charged to your Apple Account when the purchase is confirmed. A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Apple may charge the renewal within 24 hours before that period ends. You can manage or cancel the subscription in your Apple Account subscription settings. Deleting CabinCalm does not cancel a subscription.
Prices, taxes, billing, refunds and subscription management are handled by Apple and are subject to Apple’s terms and applicable consumer law. Features available through CabinCalm Pro are described on the purchase screen and must remain available for the paid subscription period, subject to reasonable service interruptions and these Terms.
5. Availability and changes
We may update, improve, suspend or discontinue parts of CabinCalm. Forecast coverage depends on third-party weather and aviation-data services and may not be available for every airport, date or condition. We do not promise uninterrupted or error-free availability.
We may update these Terms when CabinCalm or legal requirements change. Material changes will be communicated in the app or through an appropriate notice. Continued use after the effective date of updated Terms means you accept them where permitted by law.
6. Intellectual property
CabinCalm’s software, design, branding, presentation and original content are owned by us or our licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you. Your licence to the iOS application is governed by Apple’s Standard Licensed Application End User License Agreement.
7. Third-party services
CabinCalm relies on services supplied by Apple and weather, aviation-data, hosting and database providers. Those services may have their own terms and may change or become unavailable. Apple is not responsible for CabinCalm or for providing support for it, except as required by Apple’s applicable terms.
8. Disclaimer and liability
To the maximum extent permitted by law, CabinCalm is provided “as is” and “as available”. We disclaim warranties that are not required by law, including warranties of accuracy, availability and fitness for a particular purpose.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from use of, or inability to use, CabinCalm. Nothing in these Terms excludes or limits liability that cannot legally be excluded, or any mandatory consumer rights.
9. Suspension and termination
You may stop using CabinCalm at any time. We may restrict access when reasonably necessary to protect the service, other users or third parties; respond to misuse or fraud; comply with law; or address a serious breach of these Terms. Subscription cancellation remains managed through Apple.
10. Governing terms
These Terms operate alongside Apple’s Standard Licensed Application End User License Agreement and applicable consumer law. If a mandatory law in your country or region gives you additional rights, those rights remain unaffected. Any dispute will be handled by the courts or dispute-resolution bodies that have jurisdiction under applicable law.
